Terms of Service

Last updated: 21 June 2026

These Terms of Service ("Terms") govern your access to and use of SalesTrack (the "Service"), operated as a sole proprietorship based in Nairobi, Kenya ("SalesTrack", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are using SalesTrack on behalf of a business, you confirm you have authority to bind that business to these Terms.

1. The Service

SalesTrack is a point-of-sale, inventory, appointments, customer management, staff and financial reporting application designed for small and medium businesses, accessible via web browser and as an installable mobile app (PWA). Some features work offline and sync when you're back online.

2. Accounts

3. Free trial

New accounts receive a 7-day free trial with no payment card required. At the end of the trial, you must subscribe to a paid plan to retain full functionality. If you do not subscribe, your account switches to read-only mode — you can still view your existing data, but cannot create new sales, products, or other records, until you subscribe.

4. Subscription plans and billing

5. Cancellation and refunds

6. Referral and affiliate programme

Account Users who sign up using a valid referral code may receive one free month per referred shop that successfully subscribes, applied per our then-current referral terms. Our separate affiliate programme (for approved affiliate partners, not regular customers) pays a commission of 15% of referred customer payments for the first 12 months of that customer's subscription, and 10% ongoing thereafter, paid monthly via M-Pesa, subject to a signed affiliate agreement. Affiliate terms are provided directly to approved applicants and may differ from what is summarized here.

7. Your data and content

8. Acceptable use

You agree not to:

We may suspend or terminate accounts that violate these terms, with notice where reasonably possible.

9. Service availability

We aim for high uptime but do not guarantee uninterrupted access. Our offline mode allows core point-of-sale functions to continue during connectivity loss, with automatic sync once reconnected. We are not liable for losses arising from temporary unavailability of the Service, third-party services we depend on (such as M-Pesa or our hosting providers), or your own internet connectivity issues.

10. Third-party services

SalesTrack may connect with third-party services such as payment, messaging, and tax platforms where those integrations are explicitly shown as available in the Service. Your use of any active third-party integration is also subject to that provider's own terms. We are not responsible for outages, errors, or changes made by third parties.

11. Limitation of liability

To the maximum extent permitted by Kenyan law, SalesTrack is provided "as is." We are not liable for indirect, incidental, or consequential damages, including loss of profits or business data, arising from your use of the Service, except where caused by our gross negligence or willful misconduct. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 3 months preceding the claim.

In plain terms: we work hard to keep your data safe and the app running, but we can't promise it will never go wrong, and our financial responsibility if something does go wrong is limited to what you've recently paid us — not your total business losses.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your account for breach of these Terms, non-payment, or suspected fraudulent or illegal activity. On termination, your data is retained per our Privacy Policy unless you request deletion.

13. Changes to these Terms

We may update these Terms as SalesTrack grows. Material changes will be communicated to active subscribers with reasonable notice. Continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Kenya. Any disputes will first be addressed through good-faith direct negotiation; if unresolved, they will be subject to the jurisdiction of the courts of Kenya.
